I Know the Path. And I Choose it Anyway.

On April 3, 1968, Dr. Martin Luther King, Jr. delivered what would become his final public address in Memphis, Tennessee.

The speech is now known as “I’ve Been to the Mountaintop.”

The following day, Dr. King was assassinated.

The speech itself is powerful. It is moving. And in many ways, it is prophetic.

Near the end, Dr. King spoke words that still resonate today:

“I don’t know what will happen now. We’ve got some difficult days ahead. But it doesn’t matter with me now. Because I’ve been to the mountaintop.… Like anybody, I would like to live a long life. Longevity has its place. But I’m not concerned about that now.”

f you’re reading this, odds are that either you or a loved one has been injured as a result of a car accident. Car crash injuries range from soft tissue, whiplash-type injury to broken bones. That’s if the victim is lucky. Many car accident injuries are catastrophic and are often fatal.

If you or someone you love has been injured in a motor vehicle accident you have certain legal rights and there are things you should immediately do to protect those rights. CAVEAT: However, before going further about what you should do at the scene, I must first qualify the following statements: Everything contained in this section assumes that you are physically able. Cooperate with the responding police officers and responding emergency medical technicians. Explain exactly how the car crash happened and where you are experiencing pain and discomfort. Third, if an only if, you are in a safe area, and your physical condition is determined by emergency personnel to be stable, take a few pictures of the scene and the vehicles involved in the car crash. These general guidelines assume your car accident is more than a small fender bender, where no emergency personnel are required. That is obviously for you to determine at the scene. Not Guilty Verdict Issued in State of IL v. Alejandre

After a week long bench trial, Jose Alejandre was found Not Guilty of all counts in State of Illinois v. Alejandre, 17 CF 1896. For the offenses charged, this was absolutely the correct verdict.

As reported in the Daily Herald, “Kane County Judge D.J. Tegeler said he could only rule on the charges prosecutors filed against … Jose Alejandre in the death of Erik Mendez, 36…. ‘This was an absolute tragedy all the way around. It didn’t need to happen,’ Tegeler said” Trial testimony showed that the decedent attempted to pursue and confront another party goer when Mr. Alejandre intervene, ultimately resulting in the decedent falling backwards and striking his head.

In Georgia, Middle Ground for Victims of Medical Wrongdoing?

This is a posting by Georgia attorney, Mark Zamora, who can be contacted at his Atlanta office, www.ageorgialawyer.com . Mr. Zamora has asked if I would post this on my blog, which I am happy to do. His blog is germaine to Illinois medical malpractice laws, as we have seen significant restrictions implemented in the past several years, aimed at thwarting the victim from securing a fair recovery.

What the author of the opinion has proposed is that, instead of allowing victims of medical malpractice the same Constitutional Right to Trial by Jury enjoyed by all other Georgians, people harmed by medical wrongdoing/malpractice would have to get permission to have a jury trial from a “screening panel” comprised of members of the medical and insurance industries, the same industries that want to avoid compensating injured patients. This approach is wrong and adds an unnecessary, ineffective layer to our civil justice system.

The fact is all medical malpractice cases brought in Georgia have already been through multiple screening hoops. The first hoop is that you have to have had something very bad happen as a result of malpractice. Your next hoop is that you have to find a lawyer willing and able to take your case. That lawyer will tell you that there is another, special hoop that protects only professionals charged with negligence. In order to pass through that hoop, the patient must find a medical professional willing to publicly criticize their colleague and sign a document swearing that malpractice happened. So far your case has been screened three times: Something bad happens. You find a lawyer who will invest in helping you find justice. And, you find another doctor who agrees that there was malpractice and is willing to say so. Then there’s a fourth screening before you can have a jury hear your case: the judge must screen the case, too.

Our Founding Fathers created the world’s best independent screening panels when they imbedded the right to a trial by jury in our Constitution. You are entitled to a jury of your peers, not a two step process, the first of which is a trial by jury of the defendant’s colleagues. We trust the people of our communities to fairly resolve our disputes when we are unable to resolve them ourselves.

The CEO cites an approach tried in Maine as being the right fit for us here in Georgia. He fails to mention that this approach is regularly criticized by the Supreme Court of Maine as being inadequate and harmful to the people of Maine. He cites, as a reason for needing “screening panels,” a Georgia case involving a plastic surgeon who carelessly destroyed the blood supply to a woman’s face and left her horribly disfigured. He suggests that this woman – who was horribly injured through no fault of her own and who successfully navigated all of the legal hurdles to hold the wrongdoer accountable for herself and other patients – has not done enough. He says she needs to clear yet another hurdle to prove herself worthy of a jury trial. The suggestion is outrageous and it serves no purpose but to deny those who have been harmed their fair measure of justice.

Why should patients who have been harmed by medical malpractice have to go through two trials when everyone else only has to go through one? Why should medical professionals get special treatment? It’s a question with an obvious answer: They shouldn’t.

Illinois DUI Law Update

A dramatic shift in the Illinois Driving Under the Influence (DUI) law takes effect on January 1, 2009. The major changes are summarized as follows:

MONITORING DEVICE DRIVING PERMITS (MDDP) – A first offender may qualify for a MDDP, which requires motorists to have breathalyzer instruments (BAIIDs) installed into their vehicles. The MDDP replaces the Judicial Driving Permit (JDP) and allows a motorist to drive more liberally than that allowed by JDPs. MDDPs, while allowing greater mobility, are more expensive to the offender and come with greater compliance guidelines.

SUMMARY SUSPENSION PERIODS DOUBLE – As of January 1, 2009, a refusal to submit to field sobriety tests results in a 12 month suspension of driving privileges, up from 6 months under the prior law. Voluntary submission of a breath test resulting in a BAC reading of .08 or greater, will result in a summary suspension of driving privileges of 6 months, up from 3 months under the prior law.

Illinois has become progessively more conservative in its approach to driving under the influence arrests. The offense in some instances will be charged as a felony, carrying with it significant jail time. This trend toward tougher sentencing of DUI-related arrests shows signs of continuing in the future.
